CANCELLATION, REFUND AND SERVICE DISPUTE POLICY

This Cancellation, Refund, and Service Dispute Policy (“Policy”) establishes the procedures applicable to cancellations, refunds, and disputes concerning services provided by Canyon Maintenance LLC (“Canyon Maintenance,” “we,” “us,” or “our”).
This Policy applies together with Canyon Maintenance's Terms and Conditions and any applicable accepted estimate, proposal, work order, or service agreement.
1. CUSTOMER CANCELLATIONS
A customer may request cancellation of a scheduled service, project, or subscription before services begin.
Customers should provide cancellation notice as soon as reasonably possible.
Cancellation of a service does not eliminate the Customer's responsibility for costs that Canyon Maintenance has already incurred or obligations that have already arisen, including, when applicable:

Materials purchased specifically for the Customer

Special-order materials
-
Disposal or hauling costs
-
Equipment or rental costs
-
Third-party charges
-
Other non-refundable expenses
-
Services already performed
Any cancellation fee or other charge will be assessed only to the extent permitted by applicable law and the applicable estimate, proposal, or service agreement.
2. CANYON MAINTENANCE CANCELLATIONS
Canyon Maintenance reserves the right to decline, cancel, suspend, or discontinue a service, project, estimate, or recurring service arrangement when reasonably necessary.
Reasons may include, but are not limited to:

Unsafe working conditions

Severe weather
-
Lack of required property access
-
Unavailable or unsuitable materials
-
Unpaid or overdue balances
-
Misrepresentation of the property or requested work
-
Conditions outside the agreed scope
-
Discovery of hazardous or prohibited conditions
-
Failure to provide required utility or infrastructure markings
-
Customer conduct that creates an unsafe or unreasonable working environment
-
Legal or regulatory requirements
-
Circumstances beyond Canyon Maintenance's reasonable control
When reasonably practicable, Canyon Maintenance will provide notice before canceling or suspending scheduled services.
Cancellation or suspension by Canyon Maintenance does not eliminate the Customer's obligation to pay for services already performed or authorized costs already incurred.
3. REFUNDS
Canyon Maintenance does not provide automatic refunds for completed services.
Services that have already been performed are generally non-refundable.
If a refund is appropriate, Canyon Maintenance may issue a full or partial refund for services that have not been performed, subject to:

The applicable estimate or service agreement

Amounts already incurred on the Customer's behalf
-
Materials purchased
-
Disposal or equipment costs
-
Other authorized expenses
-
Applicable federal or Utah law
Any refund will be issued using a reasonable payment method and, when practicable, to the original payment method.
Nothing in this Policy prevents Canyon Maintenance from providing a refund or credit as a voluntary customer-service resolution.
4. SERVICE CONCERNS
Canyon Maintenance wants customers to be satisfied with completed work.
If a Customer believes that a service was not performed according to the agreed scope of work, the Customer should contact Canyon Maintenance as soon as reasonably possible.
For readily observable issues, Customers are encouraged to notify Canyon Maintenance within forty-eight (48) hours of service completion so that we have an opportunity to promptly inspect and address the concern.
The forty-eight (48) hour period is intended to encourage prompt reporting and does not eliminate rights or remedies that cannot legally be waived, nor does it apply to conditions that could not reasonably have been discovered within that period.
5. SERVICE DISPUTES
Customers who wish to submit a formal dispute concerning completed services should provide written notice containing:

Description of the concern

Specific portion of the work being disputed

Photographs or supporting documentation, when applicable

Requested resolution

Written notice allows Canyon Maintenance to properly document, investigate, and respond to the concern.
6. OPPORTUNITY TO INSPECT AND CORRECT
Before a Customer hires another person or company to repair, replace, modify, or redo disputed work, the Customer should provide Canyon Maintenance with reasonable notice and an opportunity to inspect the work and, when appropriate, correct the issue.
Canyon Maintenance will make reasonable efforts to investigate legitimate workmanship concerns and, when appropriate, provide a reasonable correction or other resolution.
This provision does not require a Customer to delay emergency action when immediate action is reasonably necessary to prevent injury or significant property damage.
7. EXCLUSIONS FROM WORKMANSHIP CLAIMS
Canyon Maintenance is generally not responsible for conditions or damage caused by:

Normal wear and tear
-
Customer misuse or neglect
-
Failure to follow maintenance instructions
-
Work performed or modified by another person or company
-
Pre-existing conditions
-
Defective or unsuitable materials
-
Customer-supplied materials
-
Hidden or concealed conditions
-
Underground utilities or infrastructure that were not reasonably identifiable
-
Weather or environmental conditions
-
Acts or omissions of third parties
-
Conditions outside Canyon Maintenance's reasonable control
These exclusions do not apply where prohibited by applicable law.
8. PAYMENT DURING A DISPUTE
Submitting a service dispute does not automatically suspend the Customer's obligation to pay undisputed amounts.
Customers should continue to pay any portion of an invoice that is not reasonably disputed.
Canyon Maintenance will not treat a good-faith dispute concerning a specific portion of an invoice as a waiver of its right to collect undisputed amounts.
9. RESPONSE TO DISPUTES
Canyon Maintenance will make reasonable efforts to acknowledge properly submitted written disputes within two (2) business days.
The time required to investigate and resolve a dispute may vary depending on the nature and complexity of the issue.
Canyon Maintenance may request additional information, photographs, property access, or an opportunity to inspect the work before determining an appropriate resolution.
10. RESOLUTION OF DISPUTES
Canyon Maintenance encourages customers to resolve concerns directly with the company before pursuing outside remedies.
Depending on the circumstances, a resolution may include:

Corrective work
-
Replacement of defective work or materials when appropriate

A partial credit
-
A partial refund
-
A full refund
-
Another mutually agreed resolution
-
Determination that no correction or refund is warranted
No particular remedy is guaranteed.
Nothing in this Policy limits any rights or remedies that cannot legally be waived under Utah or federal law.
11. NO AUTOMATIC ACCEPTANCE
A Customer's failure to report a concern within forty-eight (48) hours does not automatically constitute a waiver of all legal rights or remedies.
However, Customers are strongly encouraged to report visible or reasonably discoverable concerns promptly so Canyon Maintenance has a fair opportunity to inspect and address them.
Acceptance of completed work may be established by circumstances including completion of the agreed scope, inspection, continued use of the property or service, or other conduct demonstrating acceptance, subject to applicable law.
12. RECURRING SERVICES AND SUBSCRIPTIONS
For recurring maintenance services or subscriptions, cancellation of future services does not cancel or forgive amounts owed for services already performed.
Unless otherwise stated in the applicable service agreement, cancellation will apply to future service periods and will not create a refund for services already provided.
If a recurring service requires a specific cancellation notice period, that requirement will be stated in the applicable service agreement or subscription terms.
13. POLICY CHANGES
Canyon Maintenance may update this Policy from time to time.
The version of this Policy in effect when the Customer accepts an estimate, proposal, service agreement, or recurring service arrangement will generally apply to that transaction unless otherwise agreed in writing.
